Just sayin'

Was it just me, or did anyone think Cheney in that wheelchair looked like Old Man Potter out there on the podium?

Or has this one already been done to death? Most of the jokes I saw involved the Imperial March from Star Wars or somethin'.

So, um, yeah. *Dance of victory*. Yay Obama, on day one he undid the worst abuses of Executive Branch power. I wonder if there's any constitutional method to keep another president from grabbing that much power again.

We need to encode, somewhere, that when Nixon said "if the president is doing it, it isn't against the law," he was wrong.

They didn't work largely because Congress rolled over and played dead for the first six years of the Bush administration. That said, the past eight years have revealed some serious flaws in our system: an administration with a cockamamie theory of Presidential power like The Unitary Executive can flout the traditional constraints on Presidential power, largely with impunity. I'm not sure there's a structural way to fix that.

I think the structural flaw is that there's no way to prosecute executives once out of office. Right now, it's "do whatever you want, and if you get caught, resign before they put you on trial" at all levels of government.

Read your Constitution:

Article II, Section 1:
The executive Power shall be vested in a President of the United States of America.

Article I, Section 6:
No Senator or Representative shall, during the Time for which he was elected, be appointed to any civil Office under the Authority of the United States which shall have been created, or the Emoluments whereof shall have been increased during such time; and no Person holding any Office under the United States, shall be a Member of either House during his Continuance in Office.

The theory that there is not a Unitary Executive is cockamamie, not the other way around.
